Appeal a Property Code Violation Hearing Decision

If you had a hearing with a judge about a property violation and disagree with the judge’s decision, you can appeal. This means you want the Bureau of Administrative Adjudication (BAA) to take a second look at your case.

Process

Step 1.Pay your fine and file your appeal

To appeal, you must pay the full amount of your fines and penalties first. If your hearing is successful, you will get all or some of this money back. 

To pay and file your appeal, follow the instructions on the Appeal with Appeal Payment form [link to pdf]

You will also have to pay $10 for filing an appeal. You can’t get this money back, even if you win your appeal.

You must file your appeal within 30 days after the hearing decision. If you don’t file within 30 days, it will be too late. You’ll miss your chance.

What if I can’t pay the full amount of my fine?

You can ask for a waiver (exception), so you don’t have to pay before your appeal is decided. You’ll have to give us documents that show your income. Fill out the * Appeals Payment Waiver Request pdf

Step 2.Wait for a decision

You’ll get a written decision from BAA within 90 days (about 3 months). 

The appeal decision is final. You can’t appeal again and have a second hearing.

If your appeal is approved, you’ll get back any money you’re owed.
